Terms of Service

Welcome to CheckMate. By creating an account or using the app, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. The service

CheckMate is a consumer wellness and family connection app. It is designed to help people share simple daily check-ins, gentle reminders, and notes with people they choose. CheckMate is not a medical device, healthcare provider, emergency response system, or guaranteed monitoring service, and it is not a substitute for professional medical care.

2. Eligibility & account

You must be 18 or older (or have permission from a parent or legal guardian) to create an account. You're responsible for keeping your login secure and for activity in your account.

3. Subscriptions & billing

CheckMate is offered as a paid subscription with a 7-day free trial. After the trial, your selected plan begins automatically unless you cancel beforehand. See our Subscription Terms for details on auto-renewal, cancellation, and refunds.

4. Acceptable use

  • Use CheckMate only for personal, non-commercial purposes.
  • Don't attempt to reverse engineer, disrupt, or misuse the service.
  • Don't upload content that is unlawful, abusive, or violates someone else's rights.

5. Not a medical or emergency service

CheckMate does not monitor vital signs, dispatch emergency help, or provide medical advice. Notifications and reminders may be delayed or fail to deliver due to factors outside our control (internet outages, device settings, battery, carrier issues, third-party platform failures). Never rely on CheckMate alone in a medical or emergency situation. If you believe someone is experiencing a medical emergency, call 911 (or your local emergency number) immediately.

6. Disclaimer of warranties

CheckMate is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation. We do not warrant that alerts, reminders, or check-ins will always send, arrive on time, or be received.

7. Limitation of liability

To the maximum extent permitted by law, CheckMate and its affiliates, officers, employees, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, including (without limitation) injuries, medical events, emergencies, missed alerts, emotional distress, or damages arising from your use of, or inability to use, the app. Our total aggregate liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US $50.

8. Assumption of risk

You acknowledge and accept that consumer software, mobile devices, networks, and third-party platforms can and do fail. You assume the risk of relying on CheckMate for non-critical wellness and connection purposes, and agree not to use it as a substitute for medical or emergency services.

9. Third-party systems

CheckMate relies on third-party services (Apple, Google, cloud hosting, push-notification providers, analytics). We are not responsible for outages, failures, or policy changes by these third parties.

10. Class action waiver & arbitration

To the extent permitted by law, you and CheckMate agree to resolve any dispute through binding individual arbitration, and waive any right to participate in a class, collective, or representative action. Either party may still bring qualifying claims in small-claims court.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Venue for any non-arbitrable dispute lies in the state or federal courts located in Delaware.

12. Changes

We may update these Terms from time to time. Material changes will be communicated in-app. Continued use after the effective date means you accept the updated Terms.
